SERVICE TERMS AND CONDITIONS


§ 1 General Provisions

  1. The owner of the website https://coi.cloudmentor.ai (hereinafter referred to as the "Service") is CloudTeam Sp. z o.o., headquartered in Warsaw at Plac Konesera 9, NIP: 525-23-88-265, registered in the District Court for the Capital City of Warsaw, XIV Commercial Division of the National Court Register under number 0000276018 (hereinafter referred to as the "Service Provider").
  2. These Terms and Conditions define the rules and conditions of use of the Service by Users.
  3. The Terms and Conditions are made available to the User free of charge via the Service, in a form that allows their acquisition, reproduction, and recording using the User's ICT system.
  4. All copyrights related to the name of the Service, graphic design, software, database, and graphic elements of the pages made available to Users by the Service are legally protected and are the property of the Service Provider.
  5. The Service Provider undertakes to provide the Services within the scope and under the conditions specified in these Terms and Conditions.

§ 2 Definitions

  1. Personal Data Administrator – means CloudTeam Sp. z o.o., headquartered in Warsaw, which determines the purposes and means of processing Users' personal data.
  2. User – means a natural person who has reached 18 years of age, using the Services in the Service.
  3. Website – the website under which the Service is conducted, made available at https://coi.cloudmentor.ai.
  4. ICT System – a set of cooperating IT devices and software that ensures processing, storage, sending, and receiving data through telecommunication networks by means of an appropriate terminal device for a given type of network.
  5. Service – means making available to the User an online training to which they have received an invitation from the Service Provider.
  6. Invitation – information provided to the User by the Service Provider, enabling access to a specific online training in the Service.

§ 3 Technical Requirements

  1. To use the Service, a device with Internet access and a web browser with JavaScript enabled is required.
  2. It is necessary to have an active email account.
  3. During the use of the Service, cookies are installed in the User's ICT system for identification and statistical purposes, if the User's browser allows it.
  4. The Service Provider makes every effort to ensure that the use of the Service is possible on all popular devices, operating systems, and web browsers but does not guarantee full compatibility with every device and software.
  5. Use of the Service occurs via the Internet, which does not guarantee full reliability or confidentiality of communication. The Service Provider ensures encryption of data transmission by using an SSL certificate.
  6. The Service Provider strives to ensure continuous and full availability of the Service.

§ 4 Terms of Use of Services

  1. Access to the Services in the Service is only possible for Users who have received an Invitation from the Service Provider to participate in online training.
  2. After receiving the Invitation, the User can log into the Service and gain access to the trainings assigned to them.
  3. The Services provided in the Service are free of charge for Users.
  4. The User agrees to use the Services solely for their own use, in accordance with their intended purpose, these Terms and Conditions, and applicable laws.
  5. The User is obliged to maintain the confidentiality of their account access data in the Service.

§ 5 Rights and Obligations of the User

  1. The User is obliged to use the Service in a manner consistent with the law, the provisions of these Terms and Conditions, and good practices.
  2. The User may not provide content of an unlawful nature or engage in activities that could disrupt the functioning of the Service.
  3. It is prohibited to use materials and content available in the Service for commercial purposes or in a way that infringes the interests of the Service Provider.

§ 6 Liability of the Service Provider

  1. The Service Provider is liable for non-performance or improper performance of the Services, in accordance with applicable laws.

  2. The Service Provider is not liable for:

    a) damages resulting from the User's use of the Service in a manner inconsistent with the Terms and Conditions or the law;

    b) technical problems or hardware limitations on the User's side;

    c) loss of data caused by hardware failure, system failure, or other circumstances beyond the Service Provider's control.

  3. The Service Provider reserves the right to temporarily suspend access to the Service in case of necessary maintenance or updates.


§ 7 Copyright

  1. All materials, content, and graphic elements available in the Service are protected by copyright and are the property of the Service Provider or have been made available under appropriate licenses.
  2. The User has the right to use the materials available in the Service only within the scope of permitted personal use.
  3. It is prohibited to copy, distribute, modify, or otherwise use the materials available in the Service without the prior written consent of the Service Provider.

§ 8 Termination of the Agreement

  1. The User may at any time resign from using the Services by informing the Service Provider electronically.
  2. The Service Provider has the right to terminate the Service Agreement with immediate effect in case of the User's violation of the provisions of these Terms and Conditions.
  3. In the event of termination of the agreement, the User loses access to the Service and the trainings assigned to them.

§ 9 Final Provisions

  1. The Service Provider reserves the right to change these Terms and Conditions.
  2. The Service Provider will inform Users of any changes to the Terms and Conditions by sending information to the email address provided by them.
  3. If the User does not accept the introduced changes, they should inform the Service Provider within 14 days of receiving the information about the change. Lack of objection within this period means acceptance of the new Terms and Conditions.
  4. In matters not regulated in these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Act on the Provision of Electronic Services.
  5. All disputes arising in connection with these Terms and Conditions shall be resolved by the competent common courts.
  6. These Terms and Conditions come into force on 21th November 2024.
